The Presidential Election Petitions Court has stated that the Independent National Electoral Commission possessed the discretion to determine the method of transmitting election results during the presidential election held on February 25, 2023.
The five-person panel, presided over by Justice Haruna Tsammani, stated that INEC was free to specify how election results were communicated during the vote in accordance with Sections 52 and 65 of the Electoral Act 2022.
As a result, the Tribunal rejected the petition filed by the Labour Party and Peter Obi, the party’s presidential candidate. The petition demanded that President Bola Tinubu of the All Progressives Congress be declared the winner and cited the “failure” of the commission’s Results Viewing Portal to electronically upload election results in real time.
Additionally, the Tribunal denied Obi and LP’s challenges on Tinubu’s 25% support in the Federal Capital Territory, claiming that Abuja is similar to other states.
The petitioners, Obi and the LP, failed to provide evidence that Tinubu was found guilty of money laundering in the United States, according to the court.
