A Federal High Court in Abuja has fixed September 24 to hear two separate suits challenging the reinstatement of Philip Shaibu as Edo State deputy governor.
The suits, filed by the Edo Government and the State House of Assembly, seek to overturn the court’s earlier judgment that voided Shaibu’s impeachment and ordered his reinstatement.
The court’s decision comes after the Edo Government and the Assembly filed motions seeking a stay of execution of the judgment and an order suspending Shaibu’s reinstatement pending the hearing and determination of their appeals, according to Ripples Nigeria.
The motions argue that the appeals raise serious and arguable grounds, including the issue of the court’s jurisdiction to entertain the matter.
Justice James Omotosho had previously ruled that the Assembly’s impeachment proceedings were invalid due to non-compliance with due process and that the allegation against Shaibu did not constitute gross misconduct.
The September 24 hearing is expected to determine the fate of Shaibu’s reinstatement as Edo deputy governor.
“The said notice of appeal raises serious and arguable grounds.
“It raises the issue of the jurisdiction of this Honourable Court to entertain the subject matter of this suit,” they said.
