A Federal High Court in Lagos has granted an interim injunction restraining Ikeja Electric Plc and the Nigerian Electricity Regulatory Commission from implementing a tariff increase on “Band A” feeders.
The court’s ruling, delivered by Justice Chukwujekwu Aneke, is in response to an ex parte application filed by Rida National Plastics Limited, a firm affected by the tariff hike.
The injunction prevents Ikeja Electric and NERC from applying the tariff increase published in April and May 2024, pending full compliance with Section 51 of the Electricity Act, 2023.
Additionally, the court temporarily restrained the defendants from imposing a payment of N20 million on the plaintiff and from threatening or disconnecting the plaintiff’s electricity supply, according to ThisDay.
The suit, marked FHC/L/CS/1051/2024, has been adjourned until July 9, 2024, for a hearing on the motion on notice. This legal development may have implications for the electricity sector and tariff regulations in Nigeria.
